1. Agreement to Terms
By purchasing our products, using our hardware or firmware, accessing our websites (including but not limited to maustec.io, maus-tec.com, and hub.maustec.io), using our companion software or mobile apps, creating an account, or using any of our services (including Maus-Hub, Maus-Link, and any future services), you (“you,” “your,” “customer”) agree to be bound by these Terms of Service, our Privacy Policy, our Warranty Policy, our Return Policy, and any other policies referenced herein or published on our websites.
If you do not agree to these terms, you may not use our websites, purchase our products, or access our services.
We may update these terms from time to time. When we make material changes, we will notify you by email (if you have an account) or by prominent notice on our websites at least 14 days before the changes take effect. For non-material changes (formatting, clarifications), changes take effect when posted. Continued use of our products and services after changes take effect constitutes acceptance of the updated terms.
2. Age Requirement
You must be at least 18 years of age to use our websites, purchase our products, or access any Maus-Tec service.
Our products are adult devices intended exclusively for use by adults over the age of 18. By using our websites or purchasing our products, you represent and warrant that you are at least 18 years old and legally able to enter into binding contracts.
We reserve the right to refuse service, cancel orders, or terminate accounts if we have reason to believe the user is under 18.
3. Products and Services
3.1 Product Descriptions
We make every effort to describe our products accurately, including specifications, images, and pricing. However:
- Product colors may vary due to monitor differences and manufacturing variations
- Specifications are subject to change as products are improved
- Prices are subject to change without prior notice
- We reserve the right to limit quantities, refuse orders, or discontinue products at any time
3.2 Adult Products
Maus-Tec manufactures and sells electronic adult devices. By purchasing our products, you acknowledge that:
- Our products are intended for lawful adult use only
- You are responsible for ensuring that the purchase, possession, and use of our products complies with all applicable laws in your jurisdiction
- Products may not be used in any manner that is unlawful or harmful
3.3 Made-to-Order Products
Many of our products are manufactured to order. Made-to-order items:
- Require additional processing time as noted on the product listing
- Cannot be returned once manufacturing has begun (see our Return Policy)
- May be cancelled before manufacturing begins, subject to a cancellation fee (see our Return Policy)
3.4 Firmware and Software
Our hardware products include embedded firmware. By using our products, you agree that:
- Firmware is licensed, not sold, for use with the specific Maus-Tec hardware product it was designed for
- Firmware updates are provided at our discretion and may change product features or behavior
- Reverse engineering, decompiling, or modifying firmware is permitted only to the extent allowed by applicable open-source licenses included with the product
- You are responsible for backing up your device configuration before applying firmware updates
4. Online Store
4.1 Account Information
You agree to provide current, complete, and accurate information for all purchases. You agree to promptly update your account and payment information as needed.
4.2 Order Acceptance
We reserve the right to refuse or cancel any order for any reason, including but not limited to:
- Product availability
- Errors in product descriptions or pricing
- Suspected fraud or unauthorized transactions
- Orders that appear to be placed by resellers or distributors
If we cancel an order after payment has been processed, we will issue a full refund.
4.3 Payment
Store payment is processed securely by Shopify Payments. Maus-Hub Marketplace payments are processed by Stripe. We do not store your payment card information on our servers. By submitting payment, you represent that you are authorized to use the payment method provided.
4.4 Shipping
Shipping terms are governed by our Shipping Policy. You are responsible for providing a correct shipping address. International customers are responsible for any applicable customs duties, taxes, and fees.
5. Maus-Hub Platform
Maus-Hub is currently under development. The following terms will apply when the platform launches and will be updated as needed.
5.1 Accounts
When you create a Maus-Hub account:
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activity under your account
- You must notify us immediately of any unauthorized use
- We reserve the right to suspend or terminate accounts that violate these terms
5.2 Device Registration
Maus-Hub allows you to register your Maus-Tec devices for enhanced features. Device registration links your hardware’s MAC address to your account. You may unregister devices at any time.
5.3 Marketplace Content
If Maus-Hub includes a marketplace for user-created content (plugins, audio packs), additional terms governing content creation, licensing, and sales will be published in a separate Creator Agreement before the marketplace launches.
5.4 Purchased Content and Licensing
Digital content purchased through Maus-Hub is licensed for personal use on your registered devices. Licensing terms, including device limits, transfer rights, and offline availability, will be detailed in our Content Licensing Policy before marketplace launch.
6. Maus-Link Service
Maus-Link is currently under development. The following terms will apply when the service launches.
Maus-Link provides remote connectivity between Maus-Tec devices. By using Maus-Link:
- You consent to the transmission of connection data as described in our Privacy Policy
- You are solely responsible for how you use remote device connections
- You must ensure that all parties involved in a remote session have given informed, ongoing consent that may be withdrawn at any time
- Maus-Link is intended exclusively for use with genuine Maus-Tec hardware and authorized firmware. You may not use Maus-Link to relay traffic for non-Maus-Tec devices, spoof device identities, or operate unauthorized third-party services through our relay infrastructure
- You may not attempt to interfere with, overload, or abuse the Maus-Link relay infrastructure
- Free and paid service tiers may be offered; tier details and pricing will be published before launch
7. Intellectual Property
All content on our websites, product firmware, software, documentation, product names, logos, and designs are the property of Maus-Tec LLC or its licensors and are protected by applicable intellectual property laws.
Certain product images, descriptions, or trademarks displayed on our Store may belong to third-party manufacturers or distributors whose products we resell. These remain the property of their respective owners and are used under license or with permission.
You may not reproduce, distribute, modify, or create derivative works from our content without express written permission, except as permitted by applicable open-source licenses included with our products.
8. Prohibited Uses
You may not use our websites, products, or services:
- For any unlawful purpose
- To violate any applicable laws or regulations
- To infringe upon the intellectual property rights of others
- To harass, abuse, or harm any person
- To transmit malicious code, viruses, or harmful data
- To interfere with the operation of our services
- To collect personal information of other users
- To impersonate any person or entity
- To circumvent security features of our products or services
- To resell our products or services without authorization
We reserve the right to terminate your access for violating any of these prohibitions.
9. Disclaimer of Warranties
Our products and services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
We do not warrant that:
- Our services will be uninterrupted, timely, or error-free
- Our products will meet your specific expectations
- Any defects will be corrected
- Our websites are free of harmful components
The warranty for our physical products is governed exclusively by our Warranty Policy.
10. Limitation of Liability
To the maximum extent permitted by law, Maus-Tec, its officers, employees, affiliates, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from:
- Your use of or inability to use our products or services
- Any errors or omissions in our content
- Any unauthorized access to your data
- Any third-party conduct on our platforms
In no event shall our total liability exceed the amount you paid for the specific product or service giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless Maus-Tec LLC, its officers, employees, affiliates, and agents from any claim, demand, or damages (including reasonable attorneys’ fees) arising from:
- Your breach of these Terms
- Your violation of any law or third-party rights
- Your use of our products or services
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of our products and services shall be resolved in the state or federal courts located in DuPage County, Illinois.
13. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, Warranty Policy, Return Policy, Shipping Policy, and any other policies referenced herein or published on our websites (including but not limited to the Creator Agreement, and Content Licensing Policy as applicable), constitute the entire agreement between you and Maus-Tec regarding your use of our websites, products, and services.
